These differences are even more striking when examining the privacy implications of the introduction of AI-enabled CDS tools into the clinical treatment encounter. This shift exposes patient data to a new set of actors – the software developers and vendors who will be handling that data – and their broader, non-healthcare interests. Without corresponding reforms to the framework of state laws and soft law norms that require parties who handle clinical data to be careful with it, federal action will do little to protect patients’ privacy.
